Effective from Klipo version 0.1.3. Versions 0.1.0, 0.1.1, and 0.1.2 are licensed under Apache License 2.0 (see LICENSE-Apache-2.0-historical.md) and are not governed by this EULA.
This End User License Agreement ("EULA") is a legal agreement between you ("Licensee", "you", or "your") and Aydoğan Dağıdır, sole proprietor, trading as bluedev ("Licensor", "bluedev", "we", or "us") for the Klipo software product, including any associated installers, executables, updates, documentation, and supporting files (collectively, the "Software").
By downloading, installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree, do not install or use the Software.
Subject to the terms of this EULA and your payment of the applicable fees, bluedev grants you a non-exclusive, non-transferable, revocable license to install and use the Software for your personal or internal business use, on the number of devices covered by your purchased license tier (a "Seat"):
- Personal license — install on up to 3 devices that you personally own and use.
- Team / Organization license — install on the number of Seats specified in your order confirmation. Each Seat may be reassigned to a different individual but may not be shared concurrently.
A Seat is consumed when the Software is installed and activated. If you replace a device, you may release the Seat from the old device and reuse it on the new one.
You may not:
a. distribute, sublicense, sell, lease, rent, or lend the Software or any part of it to any third party; b. publish the Software on any download site, marketplace, software repository, or torrent network; c. reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the binary distribution, except to the extent such activity is expressly permitted by applicable law notwithstanding this restriction; d. remove, alter, or obscure any copyright, trademark, license, or other proprietary notice in the Software; e. use the Software to develop a directly competing clipboard manager product; f. use the Software in a manner that violates any applicable law or regulation; g. circumvent or disable any license-key check, telemetry opt-in, or update mechanism in the Software.
The historical Apache-2.0 versions (≤ 0.1.2) remain freely usable and redistributable under their original license; this EULA does not retroactively restrict them.
Your purchase entitles you to all updates within the same major version (e.g. all 0.x.y releases). Major version upgrades (1.x, 2.x, …) may be offered at an upgrade price or, at bluedev's discretion, included free.
Updates are delivered via the in-app updater. Continued use of the Software after an update constitutes acceptance of any updated EULA terms shipped with that release. Material changes will be highlighted in release notes.
The Software is licensed, not sold. bluedev (Aydoğan Dağıdır) retains all right, title, and interest in and to the Software, including all intellectual property rights. No rights are granted to you other than those expressly set out in this EULA.
Third-party components included in the Software are licensed under their respective open-source licenses. See NOTICE for a list of third-party libraries and their licenses.
The Software may collect limited, non-personal usage telemetry (crash reports, feature usage counters, version information) only when the user has explicitly opted in via Settings → Privacy. Clipboard contents, captured clip data, search queries, and any user-generated text are never transmitted off-device. See PRIVACY.md for full disclosure.
bluedev provides best-effort email support at support@bluedev.dev during the support window included with your license tier. Response times are not guaranteed.
Klipo is sold with a 14-day free trial in lieu of a money-back guarantee: buyers evaluate every Pro feature for two weeks before paying, and paid licenses are non-refundable by default. Statutory consumer rights (such as the EU 14-day right of withdrawal) continue to apply where required by law. See REFUND.md for the full policy.
This EULA is effective until terminated. It will terminate automatically without notice if you fail to comply with any of its terms. On termination, you must cease all use of the Software and destroy all copies in your possession.
bluedev may also terminate your license, with refund, if continued sale of the Software in your jurisdiction becomes unlawful or commercially impracticable.
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. BLUEDEV DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BLUEDEV (AYDOĞAN DAĞIDIR) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATED TO THIS EULA OR THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF BLUEDEV HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
BLUEDEV'S TOTAL CUMULATIVE LIABILITY UNDER THIS EULA SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, bluedev's liability is limited to the smallest extent permitted by law.
This EULA shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict-of-law principles. Any dispute arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of Istanbul, Türkiye.
This EULA, together with PRIVACY.md and REFUND.md, constitutes the entire agreement between you and bluedev concerning the Software and supersedes all prior or contemporaneous agreements, proposals, or representations, written or oral.
If any provision of this EULA is held unenforceable, the remaining provisions will continue in full force and effect.
