PREAMBLE

Sanctuary was built by and for Trans communities in Baltimore, Maryland,
in direct response to a threat model that commercial health IT vendors do
not address: the use of health records to target, expose, or harm Trans
and LGBTQIA+ people.

This License governs the use, distribution, and modification of the
Sanctuary platform. It is designed to ensure that Sanctuary remains free
for community health organizations, cannot be weaponized against the
communities it was built to protect, and remains sovereign — meaning
that any deployment retains the data sovereignty protections that define
the platform's purpose.

SECTION 1 — DEFINITIONS

"License" means this Sanctuary Community Source License v1.0.

"Software" means the Sanctuary health infrastructure platform, including
all source code, documentation, scripts, and associated materials
distributed under this License.

"Licensor" means Aziza Okoro / ThriveBMore / Radiant Threshold Staffing
Solutions, Baltimore, Maryland.

"You" means the individual or organization exercising rights under this
License.

"Derivative Work" means any work that is based on or derived from the
Software, including modifications, adaptations, translations, or works
that incorporate substantial portions of the Software.

"Community Health Organization" means a non-profit, community-based, or
publicly funded organization whose primary purpose includes direct health
services, social services, legal services, or community support for
underserved populations.

"Protected Community Members" means Trans, non-binary, gender-expansive,
LGBTQIA+, and other individuals whose identity, health history, or
personal information may be used against them in legal, immigration,
employment, or social contexts.

SECTION 2 — GRANT OF RIGHTS

Subject to the terms and conditions of this License, the Licensor grants
You a worldwide, royalty-free, non-exclusive license to:

  (a) Use, copy, and deploy the Software for non-commercial purposes;

  (b) Modify the Software and create Derivative Works;

  (c) Distribute copies of the Software and Derivative Works;

  (d) Deploy the Software as a network service for Community Health
      Organizations and their clients.

SECTION 3 — CONDITIONS

3.1 COPYLEFT (SHARE-ALIKE)

Any Derivative Work that You distribute or deploy as a network service
must be licensed under this License or a license with equivalent or
stronger protections, including equivalent Anti-Weaponization provisions.
You may not apply additional restrictions that limit the rights granted
to recipients beyond those in this License.

3.2 ATTRIBUTION

All copies and Derivative Works must include the following attribution in
all substantial portions of the Software and in any user-facing
documentation:

  Community Source License v1.0.

3.3 SOURCE INTEGRITY

You may not remove or obscure any copyright notices, license notices, or
attribution statements present in the Software. The Sanctuary Community
Source License text must accompany all distributions.

SECTION 4 — ABSOLUTE PROHIBITIONS

The following uses are prohibited regardless of any other provision of
this License. These prohibitions may not be waived.

4.1 ANTI-WEAPONIZATION

You may not use the Software, or any Derivative Work, in any manner that
knowingly or foreseeably:

  (a) Collects, stores, transmits, or reports data about Protected
      Community Members in ways that expose them to legal jeopardy,
      immigration enforcement, law enforcement targeting, employment
      discrimination, or physical harm;

  (b) Generates lists, reports, or datasets identifying individuals by
      gender identity, Trans status, sexual orientation, or any other
      protected characteristic for purposes adverse to those individuals;

  (c) Removes, disables, circumvents, or degrades any encryption,
      privacy protection, data sovereignty feature, or access control
      present in the Software;

  (d) Facilitates the use of Protected Community Members' health records
      or personal information as evidence of fraud, misrepresentation,
      or criminal conduct in any legal or administrative proceeding.

4.2 COMMERCIAL USE PROHIBITION

You may not use the Software, or any Derivative Work, for commercial
purposes — including but not limited to sale, licensing, or fee-based
deployment — without a separate written Commercial License Agreement
executed by the Licensor. Contact aziza@sanctuary-health.org to inquire
about commercial licensing.

4.3 HOSTILE ACTOR PROHIBITION

You may not use the Software if You are:

  (a) A government agency, law enforcement entity, or immigration
      enforcement agency that targets Protected Community Members;

  (b) An organization whose stated mission, policies, or recent conduct
      includes advocacy against Trans rights, gender-affirming care,
      LGBTQIA+ equality, or the legal recognition of gender identity;

  (c) A political party, political action committee, or political
      candidate whose platform includes opposition to Trans rights or
      gender-affirming care.

4.4 PROPRIETARY ENCLOSURE

You may not incorporate the Software or any substantial portion of it
into a proprietary product or service that is not made available under
this License or an equivalent open license.

SECTION 5 — COMMERCIAL LICENSING

Organizations that wish to use Sanctuary for commercial purposes, or
that require terms not provided by this License, may enter into a
Commercial License Agreement with the Licensor. Commercial licensing
revenue supports free deployments to community health organizations.

SECTION 6 — TERMINATION

6.1 This License and all rights granted under it terminate automatically
and immediately upon any violation of Section 4 (Absolute Prohibitions).
There is no cure period for Section 4 violations. Weaponization cannot
be undone retroactively.

6.2 This License terminates upon material breach of any other provision
if the breach is not cured within thirty (30) days of written notice
from the Licensor.

6.3 Termination does not affect the rights of any third party that has
received a compliant copy of the Software prior to termination.

SECTION 7 — DISCLAIMER OF WARRANTY

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS
OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY CLAIM, DAMAGES, OR
OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE,
ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR
OTHER DEALINGS IN THE SOFTWARE.

SECTION 9 — GENERAL PROVISIONS

9.1 GOVERNING LAW: This License shall be governed by the laws of the
State of Maryland, United States, without regard to its conflict of law
provisions.

9.2 SEVERABILITY: If any provision of this License is held invalid or
unenforceable, the remaining provisions shall continue in full force.

9.3 ENTIRE AGREEMENT: This License constitutes the entire agreement
between the parties regarding the Software and supersedes all prior
agreements relating to the same subject matter.

9.4 AMENDMENTS: This License may be updated by the Licensor. Updated
versions will bear a new version number. You may comply with either the
version under which You received the Software or any later version.
